Fair Dealing under U.K. Copyright Designs and Patents Act 1988
Abstract The word “dealing” in “fair dealing cases” with copyright material refers to the use of the material in any of the ways reserved to the copyright owner. The fairness of the use of copyright material depends on the situations of the case. This article discusses the scope of the fair dealing cases and tries to analyze the factors involved in fair dealing cases. It is concluded that three elements must be shown by the defendant in order to benefit from the defense of fair dealing and they are the following: (i) that the dealing is for the purpose of either criticism, review or newspaper summary; (ii) that the dealing is "fair" with regards to the purpose in question; and (iii) that the appropriate acknowledgements are made.
