The Historic Roots of Norwegian Pollution Law
1. Introduction
In this article I shall take a look at the historic roots of an important part of the environmental law of Norway: the law on pollution control and liability for damage caused by pollution.
Today, Norway has a Pollution Control and Waste Management Act of 1981, which applies to all sorts of pollution from stationary sources – water, air and soil pollution as well as solid waste. It demands an integrated approach to the control of pollution from the individual sources. It is the result of a development from quite modest pieces of legislation covering only very limited problems, to a steadily broader scope and more general rules.
The main emphasis of the article is on the first phase in Norway’s way towards a modern pollution legislation, until the end of the 19th century. During the last part of the 19th century important new concepts were developed – and new laws were adopted – which have influenced Norwegian environmental law until the present day. I have searched for the main roots of this development, and the events which influenced it.
It will come as no surprise that the legal development is closely linked to the technical and industrial development. However, one may also ask how the problem of pollution was perceived in earlier days. Today, there are various views and basic approaches to pollution. To simplify, three quite different approaches may be defined:
